Organiser Terms and Conditions
1.1 Introduction
1.1.1 Purpose & Scope
Welcome to Chepa Ticket Zone ("Platform," "we," "us," or "our"). These Terms of Service ("Terms") govern the use of our online ticketing platform, which facilitates the buying, selling, and promotion of event tickets.
By accessing or using our platform, you ("User," "Event Organizer," "Vendor," "Buyer") agree to be bound by these Terms and Conditions, our Privacy Policy, and any other policies referenced herein. If you do not agree to these terms, you should refrain from using the platform.
1.1.2 Parties & Legal Relationship
- Chepa Ticket Zone is a digital platform for ticket sales, officially registered on September 22, 2024, under the Patents and Companies Registration Agency (PACRA) in Zambia, with Business Registration No. 320241025551. The business is owned by Eric Moonga.
- Chepa Ticket Zone provides a marketplace for event organizers to list and sell tickets while enabling customers to purchase tickets for various events.
- We do not own, host, or manage the events listed on the platform. Event organizers are solely responsible for their events, including compliance with all legal, regulatory, and safety requirements.
- Ticket buyers acknowledge that Chepa Ticket Zone is not the event host and has no control over event quality, cancellations, or modifications.
1.1.3 Acceptance of Terms
- You are at least 18 years old (or meet the legal age requirement in your jurisdiction).
- You have the legal authority to enter into this agreement.
- You will comply with all applicable laws and regulations related to ticketing, event hosting, and financial transactions.
- You accept that Chepa Ticket Zone reserves the right to modify these Terms at any time, with updates taking effect upon posting on the platform.
1.2 Payment & Fees
1.2.1 Accepted Payment Methods
Chepa Ticket Zone offers a variety of secure payment options for ticket purchases and event registrations. Accepted methods include:
- Credit & Debit Cards (Visa, MasterCard, American Express, etc.)
- Mobile Money & Digital Wallets (where available)
- Bank Transfers (for bulk or corporate purchases)
- Cryptocurrency Payments (if applicable and supported)
All transactions are processed securely through third-party payment processors. Chepa Ticket Zone does not store users' full payment details.
1.2.2 Service Fees & Charges
- Ticket Buyers: A service fee (flat rate of K8 or percentage-based) may apply to each ticket purchased. This will be displayed at checkout.
- Event Organizers: A commission fee of 6% is deducted from each ticket sale before payouts. Additional fees may apply for marketing, promotions, or premium services.
- Refund Processing Fees: Some refunds may be subject to processing fees, depending on the payment method and timing of the request.
- Payment Processing Fees:
- 2.5% Mobile Money Collections: Charged to the buyer using mobile money.
- 2.5% Mobile Money Disbursement: Covered by the organizer for mobile money payouts.
- 5% Card Collections: Applied to buyers using bank cards.
- 5% Card Disbursement: Applied when funds are transferred to a bank account.
- 2% Settlement to Bank: Charged when funds are moved to a business bank account.
Note:
- Sending money to an event organizer's mobile wallet incurs a 2.5% charge.
- Sending money to an event organizer's bank account incurs a 5% charge.
1.2.3 Currency & Exchange Rates
- Transactions are processed in the default currency of the platform or as selected by the user.
- If a different currency is used, exchange rates and conversion fees may apply. These rates are determined by payment processors and are beyond Chepa Ticket Zone’s control.
1.2.4 Refunds & Chargebacks
- Refunds are subject to the event organizer’s policies. If an event is cancelled or rescheduled, Chepa Ticket Zone will facilitate refunds where applicable.
- Chargebacks initiated by a user must be justified and may result in account suspension if found fraudulent.
- Disputed transactions between buyers and organizers will follow Chepa Ticket Zone’s Dispute Resolution Policy.
1.2.5 Payouts to Event Organizers
- Funds from ticket sales are held in escrow until after the event to prevent fraud.
- Payouts are typically processed within 7–14 business days after the event concludes.
- Organizers must provide valid bank details, and any payment processing fees will be deducted before payout.
1.2.6 Taxes & Compliance
- Users are responsible for any applicable taxes related to ticket purchases or event revenues.
- Event organizers must comply with tax regulations in their respective jurisdictions.
- Chepa Ticket Zone may report transactions to tax authorities if required by law.
1.4 Event Listings & Sales Policies
1.3.1 Event Listing Requirements
- Organizers must provide accurate event details, including name, date, time, location, ticket price, and restrictions.
- Events requiring permits must comply with local laws.
- Listings must not contain false or misleading advertising.
- Prohibited events include those promoting illegal activities, violence, or hate speech.
- Chepa Ticket Zone reserves the right to remove or suspend non-compliant events.
1.3.2 Ticket Pricing & Availability
- Organizers control ticket pricing and availability, ensuring transparency with no hidden fees.
- Discounts, promo codes, and tiered pricing must be clearly disclosed and honored.
- Chepa Ticket Zone is not responsible for pricing errors by event organizers.
1.3.3 Ticket Sales & Delivery
- Tickets are delivered digitally unless otherwise specified.
- For physical delivery, the organizer is responsible for timely dispatch.
- Buyers receive tickets immediately upon successful payment unless stated otherwise.
1.3.4 Event Changes & Cancellations
- Rescheduled events notify buyers immediately, keeping tickets valid.
- Cancelled events entitle buyers to refunds per event terms.
- Refunds for cancelled events are processed within 7–14 business days, subject to fees.
- Organizers must notify Chepa Ticket Zone of event modifications.
1.3.5 Fraud Prevention & Unauthorized Reselling
- Ticket scalping (reselling at higher prices) is prohibited.
- Use of bots, fake accounts, or bulk purchasing to manipulate availability is forbidden.
- Fraudulent events or counterfeit tickets result in account suspension and legal action.
1.3.6 Liability & Disclaimers
- Chepa Ticket Zone is not responsible for event logistics, quality, or attendee experience.
- Buyers assume all risks associated with attendance, including venue policies and security screenings.
- Organizers bear full responsibility for event execution and attendee safety.
1.8 Account Termination & Appeals
1.8.1 Voluntary Account Termination
- Users may choose to close their Chepa Ticket Zone account at any time by submitting a termination request via the platform’s account settings or contacting customer support.
- Users must ensure that there are no outstanding payments, pending ticket disputes, or unresolved issues before closing the account.
- Any unused tickets, stored credits, or promotional offers will be forfeited upon account closure.
- Once an account is closed, all personal data will be handled according to the Privacy Policy, and some records may be retained for compliance with legal or financial regulations.
1.8.2 Involuntary Account Termination (Suspension or Ban)
- Chepa Ticket Zone reserves the right to suspend, restrict, or permanently terminate an account without prior notice if the user is engaged in fraud, scams, or deceptive practices such as fake event listings, ticket scalping, or chargeback abuse.
- Repeated violations of the Terms of Service, including non-compliance with refund policies, security breaches, or misconduct, may result in termination.
- Hacking, data scraping, or unauthorized system access can lead to immediate suspension or a permanent ban.
- Significant customer complaints that remain unresolved may result in account termination.
- Users involved in illegal activities or violations of ticket sales and event-hosting laws may be banned immediately.
1.8.3 Notification of Suspension or Termination
- Chepa Ticket Zone will send an email notification explaining the reason for account suspension or termination.
- Instructions on how to appeal (if applicable) will be provided.
- For permanent bans, users will be informed of any remaining financial obligations, such as unpaid fees or refunds owed.
1.8.4 Appeals & Reinstatement
- Users who believe their account was wrongfully suspended or terminated may submit an appeal by contacting Chepa Ticket Zone’s Support Team within 14 days of receiving the suspension notice.
- Supporting documentation or explanations must be provided to contest the decision.
- Users must agree to rectify any policy violations if reinstatement is granted.
- Chepa Ticket Zone will review appeals within 7-14 business days and provide a final decision. Not all appeals will be approved, especially in cases of serious fraud or repeat violations.
1.8.5 Effect of Termination
- All active tickets and pending transactions may be cancelled, subject to event organizer policies.
- Users will lose access to their account history, stored credits, and promotional discounts.
- Any outstanding payments, fees, or penalties must still be fulfilled by the user.
- Chepa Ticket Zone retains the right to pursue legal action against users who have committed fraud, caused financial losses, or violated contractual obligations.
1.9 Dispute Resolution & Legal Compliance
1.9.1 General Dispute Resolution Policy
- Chepa Ticket Zone is committed to providing a fair and transparent process for resolving disputes between:
- Buyers and Event Organizers (e.g., refund requests, ticket validity issues).
- Event Organizers and Chepa Ticket Zone (e.g., payout disputes, service fees).
- Buyers and Chepa Ticket Zone (e.g., unauthorized charges, fraudulent transactions).
- All disputes must first be reported to Chepa Ticket Zone’s customer support team before any legal action is pursued.
1.9.2 Dispute Resolution Process
- Initial Complaint Submission
- Users must submit a written complaint via the Chepa Ticket Zone Help Centre within 7 days of the issue occurring.
- The complaint should include supporting evidence, such as screenshots, transaction details, or event correspondence.
- Internal Review & Mediation
- Chepa Ticket Zone will review the dispute within 7-14 business days and attempt to mediate between the parties.
- If a resolution is reached, the case will be closed.
- Escalation & Arbitration
- If mediation fails, the dispute may be escalated to formal arbitration or legal proceedings, as specified in these Terms.
- Arbitration decisions are final and binding on both parties.
- Note: Chepa Ticket Zone does not handle event-related disputes (e.g., dissatisfaction with event quality). Such disputes must be resolved directly between the buyer and event organizer.
1.9.3 Refund & Chargeback Disputes
- Buyers should request refunds through Chepa Ticket Zone instead of initiating chargebacks with their bank.
- Unauthorized chargebacks may result in account suspension.
- If a chargeback is filed, Chepa Ticket Zone reserves the right to dispute it and provide transaction records as evidence.
1.9.4 Legal Compliance & Governing Law
- These Terms are governed by the laws of [Specify Jurisdiction], without regard to conflict of law principles.
- Users agree to comply with all applicable laws and regulations, including:
- Consumer protection laws (for ticket buyers).
- E-commerce regulations (for online transactions).
- Tax laws (for event organizers managing ticket sales revenue).

1.9.5 Force Majeure Clause
- Chepa Ticket Zone is not liable for disruptions caused by unforeseen circumstances, including:
- Natural disasters, pandemics, government restrictions, or acts of war.
- Cyberattacks or technical failures beyond our control.
- Strikes, labor disputes, or transportation failures affecting events.
- In such cases, Chepa Ticket Zone will work with organizers to issue refunds where applicable but cannot guarantee full compensation for losses.
1.9.6 Changes to Terms & Dispute Policies
- Chepa Ticket Zone reserves the right to update these Terms at any time.
- Users will be notified of major changes via email or platform announcements.
- Continued use of the platform after an update constitutes acceptance of the revised terms.
Vendor & Organizer Agreement
2. Contractual Obligations
2.1 Contractual Obligations
This agreement establishes the terms between Chepa Ticket Zone ("Platform") and Event Organizers/Vendors ("Organizer," "You"). By listing events and selling tickets on the platform, you agree to:
- Comply with all platform policies, laws, and regulations related to event hosting and ticket sales.
- Ensure the accuracy of event details (dates, pricing, availability, and terms).
- Deliver events as promised and manage customer expectations professionally.
- Handle disputes and refund requests in accordance with the platform’s policies.
Failure to adhere to these obligations may result in account suspension, withheld payments, or legal action.
2.2 Revenue & Payouts
Organizers earn revenue from ticket sales, subject to the following conditions:
- Commission Fees: Chepa Ticket Zone deducts a percentage-based or flat commission per ticket sale (as agreed in the listing contract).
- Payout Schedule:
- Funds are held in escrow until after the event to prevent fraud.
- Payouts are processed within 7–14 business days post-event.
- Bank transfer, mobile money, or other approved methods may be used.
- Refunds & Chargebacks:
- If an event is canceled, refunds must be issued as per the refund policy.
- If excessive chargebacks occur, payouts may be delayed or withheld until disputes are resolved.
- Taxation & Compliance:
- Organizers are responsible for declaring and paying taxes on ticket revenue.
- Chepa Ticket Zone may report transactions to tax authorities if required.
2.3 Cancellation, Postponements & Refunds
- Organizer-Initiated Cancellations: If an organizer cancels an event, all ticket buyers must be fully refunded, unless a reschedule option is provided.
- Postponements & Changes:
- Buyers must be notified immediately of any event modifications.
- Tickets should remain valid for the rescheduled date or an alternative refund option must be offered.
- Refund Processing:
- Refunds must be processed within 7–14 business days.
- Organizers who fail to process refunds may be subject to penalties or legal action.
- No-Refund Events: If an event is explicitly non-refundable, this must be clearly stated in the listing.
Chepa Ticket Zone reserves the right to issue mandatory refunds in cases of fraud, failure to deliver an event, or unresolved customer disputes.
Liability & Dispute Resolution
3.1 Limitation of Liability
- Chepa Ticket Zone is a ticketing platform facilitating transactions but does not host, manage, or control events.
- We are not responsible for:
- Event cancellations, postponements, or changes.
- Event quality, safety, or attendee experience.
- Ticket resale, unauthorized duplication, or fraudulent listings.
- Financial Losses: Chepa Ticket Zone is not liable for losses from:
- Event non-performance.
- Ticket pricing errors.
- Payment processing delays.
- Unauthorized third-party activities.
- Technical Issues: Chepa Ticket Zone is not responsible for:
- Platform downtime.
- Service interruptions.
- Payment gateway failures beyond our control.
- Liability is limited to the total service fees collected for the disputed transaction.
3.2 Indemnification
- You agree to indemnify Chepa Ticket Zone against claims from:
- Misuse of the platform.
- Failure to comply with laws.
- Fraudulent activity or negligence.
- Violations of intellectual property rights.
- Organizers and vendors assume full liability for disputes with customers or authorities.
3.3 Dispute Resolution Process
3.2.1 Filing a Complaint
- Disputes must be submitted via the Help Centre within 7 days.
- Complaints should include transaction details and supporting evidence.
3.2.2 Internal Review & Mediation
- Disputes are reviewed within 7-14 business days.
- We mediate resolutions between buyers and organizers.
3.2.3 Escalation to Arbitration
- If unresolved, disputes proceed to arbitration.
- Arbitration decisions are final and binding.
- Legal fees may be shared between disputing parties.
3.4 Refund & Chargeback Policies
- Refund eligibility is determined by organizers.
- Buyers must submit refund requests before the event date.
- Event cancellations result in refunds per organizer agreements.
- Unauthorized chargebacks may lead to account suspension.
3.5 Governing Law & Jurisdiction
- These terms are governed by the laws of Zambia.
3.6 Force Majeure Clause
- Chepa Ticket Zone is not liable for failures due to:
- Natural disasters.
- Political unrest.
- Pandemics.
- Cybersecurity threats.
- Refund processing will be attempted but not guaranteed.
3.7 Legal Compliance & Platform Policy Changes
- Policies may be modified to comply with legal or regulatory changes.
- Users will be notified of major updates.
- Continued platform use constitutes acceptance of new terms.
Intellectual Property & Content Rights
4.1 Ownership of Content
- Chepa Ticket Zone owns all platform-related intellectual property (including the website, mobile app, branding, software, and design elements).
- Users and event organizers retain ownership of any content they upload, such as event descriptions, images, videos, and promotional materials.
- By submitting content to the platform, users grant Chepa Ticket Zone a non-exclusive, royalty-free, worldwide license to use, display, and promote that content for marketing and operational purposes.
4.2 Copyright & Trademark Protection
- Users may only upload content they own or have permission to use.
- Unauthorized use of copyrighted materials (e.g., music, logos, images) is strictly prohibited.
- Event organizers are responsible for ensuring their event listings comply with intellectual property laws.
- If Chepa Ticket Zone receives a copyright infringement claim, we may:
- Remove or disable access to the infringing content.
- Suspend or terminate the user’s account if violations persist.
4.3 Use of Chepa Ticket Zone Branding
- The Chepa Ticket Zone name, logo, and trademarks cannot be used without prior written permission.
- Unauthorized use of Chepa Ticket Zone branding in advertising, promotions, or misleading contexts is strictly prohibited.
4.4 Third-Party Content & Links
- Some events may include third-party content or external links (e.g., artist promotions, sponsor pages).
- Chepa Ticket Zone is not responsible for third-party content and does not endorse any linked external websites.
4.5 Content Removal & Violations
- Chepa Ticket Zone reserves the right to remove or disable any content that:
- Violates copyright, trademark, or intellectual property laws.
- Contains misleading, false, or deceptive advertising.
- Promotes illegal activities, hate speech, or harmful content.
- Is reported by copyright owners or affected parties.
- Repeat violations may result in account suspension and legal consequences.
4.6 User Responsibilities for Uploaded Content
- Event organizers must verify the accuracy and originality of their event listings and promotional materials.
- If an organizer or user uploads copyrighted material without permission, they will be fully liable for any legal claims or damages.
- Users can report intellectual property violations via Chepa Ticket Zone’s Help Centre for prompt action.
4.7 DMCA & Copyright Infringement Policy
- Chepa Ticket Zone follows the Digital Millennium Copyright Act (DMCA) and other applicable copyright laws.
- Copyright holders can submit a takedown request if their work is used without permission.
- Affected users will be notified and may file a counter-notification if they believe the removal was a mistake.
Compliance & Regulatory Considerations
5.1 Adherence to Local, National, and International Laws
- Users must comply with local event regulations, including venue capacity, safety requirements, and noise ordinances.
- Consumer protection laws related to fair pricing, refunds, and dispute resolution.
- E-commerce laws governing online transactions, digital goods, and fraud prevention.
- Privacy and data protection laws such as GDPR (EU), CCPA (California), and other regional regulations.
- Tax compliance laws applicable to ticket sales and revenue reporting.
Users are responsible for understanding and following the laws in their jurisdiction regarding event hosting and ticket sales.
5.2 Taxation & Financial Reporting
- Organizers are responsible for any taxes on ticket sales, including VAT, GST, and local sales tax.
- Chepa Ticket Zone may report earnings to tax authorities, depending on jurisdiction.
- In some cases, the platform may automatically deduct and remit taxes for certain regions.
- Organizers must provide valid tax identification numbers where required.
Failure to comply with tax regulations may result in withheld payments or account suspension.
5.3 Anti-Fraud & Security Measures
- Transaction monitoring for unusual or high-risk activity.
- User verification checks for event organizers and large-ticket purchases.
- Automated fraud detection to identify bots, fake accounts, or suspicious sales patterns.
- Immediate suspension of accounts involved in fraudulent transactions or chargeback abuse.
Any suspected fraudulent activity may be reported to law enforcement for investigation.
5.4 Consumer Protection & Ticketing Transparency
- Organizers must clearly disclose all ticket fees, service charges, and refund policies.
- Honor stated refund and cancellation policies without misleading terms.
- Avoid false advertising, misrepresentation, or hidden costs.
- Provide contact information for customer support inquiries.
Violations of consumer protection laws may result in account penalties or legal action.
5.5 Accessibility & Inclusivity Requirements
- Events must comply with accessibility laws like the Americans with Disabilities Act (ADA) or equivalent local regulations.
- Organizers must disclose accessibility features (e.g., wheelchair access, sign language interpreters, assistive technology).
- Discriminatory practices (e.g., refusing service based on race, gender, religion, disability) are strictly prohibited.
Failure to meet accessibility requirements may result in event removal or legal consequences.
5.6 Age Restrictions & Legal Considerations
- Organizers must clearly label age-restricted events (e.g., 18+ or 21+ events).
- Events involving alcohol, gambling, or adult content must comply with licensing requirements.
- Chepa Ticket Zone reserves the right to restrict listings that violate age-related laws.
Violations of age restriction policies may result in ticket refunds, event removal, or legal action.
5.7 Compliance Audits & Investigations
- Chepa Ticket Zone reserves the right to audit events, transactions, and user activity for compliance.
- Users may be required to submit documentation (e.g., event permits, ID verification, tax records) upon request.
- Accounts under investigation may experience temporary restrictions or payment holds.
Serious violations may be escalated to regulatory authorities or law enforcement.
5.8 Policy Updates & Compliance Changes
- This Compliance & Regulatory Policy is subject to change based on legal updates, new regulations, or platform improvements.
- Users will be notified of significant changes, and continued use of the platform constitutes acceptance of the updated terms.
- Non-compliance with updated policies may result in restricted platform access or legal consequences.
